1. Acceptance of Terms
By downloading, installing, or using the DeepDate application or website (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.
These Terms constitute a legally binding agreement between you and Kafeinman ("we", "our", or "us"), the company that develops and operates DeepDate, headquartered in Ankara, Turkey.
2. Eligibility
To use DeepDate, you must:
- Be at least 18 years of age
- Have the legal capacity to enter into a binding contract in your jurisdiction
- Not be prohibited from using the Service under applicable law
- Not have been previously banned from DeepDate for violations of these Terms
By registering, you represent and warrant that you meet all eligibility requirements above. We reserve the right to verify your age and identity at any time.
3. Your Account
3.1 Registration
You must provide accurate, current, and complete information during registration. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.
3.2 One Account Per Person
You may only create one account per person. Creating multiple accounts to circumvent a ban or exploit the Service is prohibited.
3.3 Profile Authenticity
Your profile must represent you accurately. You may not impersonate another person, use someone else's photos, or create a misleading profile. All users are required to complete the AI liveness verification before their profile becomes visible to others.
3.4 Account Security
You must immediately notify us at support@deepdate.app if you suspect any unauthorized use of your account. We are not liable for losses resulting from unauthorized account access where you failed to notify us promptly.
4. Acceptable Use
You agree not to use the Service to:
- Harass, abuse, threaten, stalk, or intimidate other users
- Post or transmit content that is hateful, discriminatory, obscene, or illegal
- Send unsolicited commercial messages (spam)
- Solicit money or financial information from other users
- Attempt to deceive users for romantic or financial purposes (romance scams)
- Upload malicious code, viruses, or any software that could harm the Service or other users
- Attempt to reverse-engineer, scrape, or extract data from the Service
- Use automated bots, scripts, or tools to interact with the Service
- Circumvent any security feature, including the AI liveness check
- Violate any applicable local, national, or international law
Violations of these rules may result in immediate account suspension or permanent ban, with or without prior notice, at our sole discretion.
5. User Content
5.1 Ownership
You retain ownership of all content you post on DeepDate, including photos, messages, and profile information.
5.2 License to Us
By posting content on the Service, you grant Kafeinman a non-exclusive, royalty-free, worldwide, sublicensable license to use, display, reproduce, and distribute that content solely for the purpose of operating and improving the Service.
5.3 Content Standards
All content you post must:
- Be photos of yourself (profile photos)
- Not contain nudity, explicit sexual content, or graphic violence
- Not infringe any third party's intellectual property rights
- Not depict minors in any romantic or inappropriate context
We reserve the right to remove any content that violates these standards, without notice or liability.
5.4 Messages
Private messages between users are stored to enable the Service's messaging feature. We do not proactively read your messages, but we may review reported conversations to enforce these Terms and ensure user safety.
6. AI Features
6.1 Liveness Verification
The AI liveness check is a safety feature intended to confirm that you are a real person. You must not attempt to bypass it using photos, videos, masks, or other means. Attempting to circumvent verification is a violation of these Terms and will result in account termination.
6.2 AI Matching
DeepDate uses machine learning to rank potential matches based on your preferences. This ranking is probabilistic and is intended as a tool to help you discover compatible people — it does not guarantee any particular outcome.
6.3 No Guarantee of Matches
We do not guarantee that you will find a romantic partner, friendship, or any specific result from using the Service. Outcomes depend on many factors beyond our control.
8. Termination
8.1 By You
You may delete your account at any time from the app settings. Upon deletion, your profile, messages, photos, and face embeddings will be permanently removed within 30 days.
8.2 By Us
We may suspend or terminate your account at any time, with or without notice, if we believe you have violated these Terms, engaged in fraud, or if required by law. In the event of termination, no refund will be issued for any remaining subscription period.
8.3 Effect of Termination
Upon termination, your right to use the Service ceases immediately. Provisions that by their nature should survive termination (including Sections 5, 9, 10, and 11) will continue to apply.
9. Disclaimer of Warranties
The Service is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.
We do not warrant that:
- The Service will be uninterrupted or error-free
- Any defects will be corrected
- The Service or servers are free of viruses or harmful components
- Results obtained through the Service will be accurate or reliable
10. Limitation of Liability
To the maximum extent permitted by applicable law, Kafeinman shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, goodwill, or other intangible losses, arising from:
- Your use of or inability to use the Service
- Any conduct or content of other users
- Unauthorized access to or alteration of your data
- Any other matter relating to the Service
Our total liability to you for any claim arising out of or relating to these Terms or the Service shall not exceed the amount you paid us in the 12 months preceding the claim, or €100, whichever is greater.
11. Governing Law
These Terms are governed by the laws of the Republic of Turkey, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of Ankara, Turkey, unless otherwise required by applicable consumer protection law in your jurisdiction.
If you are a consumer in the European Union, you may also have the right to use the EU Online Dispute Resolution platform at ec.europa.eu/consumers/odr.
12. Changes to These Terms
We may modify these Terms at any time. We will notify you of material changes via in-app notification or email at least 14 days before they take effect. Your continued use of the Service after changes take effect constitutes your acceptance of the revised Terms.
If you do not agree to the updated Terms, you must stop using the Service and delete your account before the changes take effect.
